Agreement to Terms

By downloading, installing, or using the GetJacked iOS mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

GetJacked is a fitness application that provides workout tracking, exercise programs, progress monitoring, and related fitness features. The App is designed to help users achieve their fitness goals through personalized training programs and comprehensive workout tracking.

User Responsibilities

By using the App, you agree to:

• Provide accurate and truthful information when using the App

• Use the App only for lawful purposes and in accordance with these Terms

• Not interfere with or disrupt the App's functionality

• Not attempt to gain unauthorized access to any part of the App

• Respect the intellectual property rights of GetJacked and third parties

• Not use the App for any commercial purposes without written consent

Intellectual Property

The App and its entire contents, features, and functionality are owned by GetJacked and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the App without explicit written permission.

Third-Party Trademarks: Apple®, App Store®, TestFlight®, iOS®, iPhone®, iPad®, and HealthKit® are registered trademarks of Apple Inc. All other trademarks are the property of their respective owners.

User Content and Data

You retain ownership of any content you create or upload through the App ("User Content"). By using the App, you grant GetJacked a limited, non-exclusive license to use your User Content for the purpose of providing and improving the App's services.

You are solely responsible for your User Content and warrant that it does not violate any third-party rights or applicable laws.

Account Deletion: You may request deletion of your account and associated data at any time by contacting us at the email address provided in the Developer Contact Information section below. We will process account deletion requests within 30 days.

Data Collection: The App only collects data necessary for core functionality. For detailed information about what data we collect and how we use it, please review our Privacy Policy.

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand our practices regarding the collection and use of your information.

Auto-Renewable Subscriptions

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GETJACKED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App

• Any unauthorized access to or use of our servers and/or personal information

• Any bugs, viruses, or other harmful code that may be transmitted through the App

• Any errors or omissions in content or for any loss or damage incurred as a result of the use of any content

Indemnification

You agree to defend, indemnify, and hold harmless GetJacked and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the App.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will cease immediately.

App Store Terms and Apple Requirements

Your use of the App is also subject to the terms and conditions of the Apple App Store. In the event of any conflict between these Terms and the App Store terms, the App Store terms shall prevail with respect to your use of the App.

Important Apple App Store Acknowledgements:

• This agreement is between you and GetJacked only, not Apple Inc. ("Apple")

• Apple is not responsible for the App or its content. Any claims relating to the App must be directed to GetJacked

• GetJacked is solely responsible for providing maintenance and support services for the App

• In the event the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price. Apple has no other warranty obligations

• Apple is not responsible for addressing any claims by you or third parties relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims

• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties

• Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce these terms

Governing Law

These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the appropriate courts.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. Your continued use of the App after any changes constitutes acceptance of the new Terms.
